But even with all that momentum, the rules around buying, possessing, and consuming cannabis in New Jersey can be confusing, especially as new laws continue to roll out.

We’ll cover who can buy, how much you can purchase and carry, where you can consume, what you’ll pay in taxes, and the major legal changes happening this year.
Who Can Buy Cannabis in New Jersey?
New Jersey makes it straightforward. Any adult 21 years or older can walk into a licensed recreational dispensary and purchase cannabis. There is no residency requirement — you don’t need to be a New Jersey resident, so visitors from out of state (including those coming across the bridge from Delaware or Pennsylvania) are welcome. All you need is a valid, unexpired government-issued photo ID proving you’re 21 or older. A driver’s license, state ID, passport, or U.S. military ID all work.
Medical cannabis patients must hold a valid New Jersey medical marijuana card issued through the state’s Medicinal Marijuana Program. Medical patients have a different monthly purchase structure and are completely exempt from sales tax, which we’ll cover below.
How Much Cannabis Can You Buy Per Visit?
New Jersey law caps recreational purchases at one ounce of cannabis per person, per day. That’s the equivalent of 28.35 grams of flower, or the equivalent across other product types. Here’s how that breaks down:
- Flower and pre-rolls: Up to 28.35 grams (1 ounce) of flower or pre-rolls per day
- Concentrates: Up to 4 grams of solid concentrates or resin, or the equivalent in liquid form
- Edibles: Up to 1,000 mg of THC total in edible and drinkable products. Individual packages max out at 100 mg each, and every package is divided into measured doses of 5 or 10 mg — so a 100 mg package of gummies might contain twenty 5 mg pieces or ten 10 mg pieces. Cannabis drinks work the same way: shot-sized syrups come in 100 mg bottles with caps that measure out 10 mg doses, and THC seltzers are on the way
- Vape cartridges: Counted toward the concentrate limit — a 1-gram vape cartridge counts the same as 1 gram of rosin, live resin, or any other concentrate, so 4 grams total across all concentrate products per day
You can mix and match product types within a single visit, but your total for the day must stay within the one-ounce equivalent. This is a per-person, per-day limit — not per transaction. If the math gets confusing, don’t stress — your budtender will track it for you at checkout. Dispensaries are required by law to monitor purchase limits.
How Much Cannabis Can You Legally Carry?
New Jersey adults 21 and older can possess up to 6 ounces of cannabis flower (or the equivalent in cannabis products) at any time. That’s separate from the per-transaction purchase limit — you can buy an ounce at a time, but you’re allowed to have up to six ounces total on your person or in your home.
Exceeding 6 ounces is a fourth-degree crime in New Jersey, punishable by up to 18 months of imprisonment and fines up to $25,000. The bottom line: know your limits and stay within them.
Where Can You Consume Cannabis in NJ?
This is one of the most commonly misunderstood parts of New Jersey cannabis law. You can’t just light up anywhere. Here’s where consumption is and isn’t allowed:
- Private property: Yes — your own home or a friend’s home with permission. However, landlords and property managers can prohibit cannabis use on their property, so renters should check their lease.
- Licensed consumption lounges: Yes — as of July 2025, New Jersey has approved the first cannabis consumption areas attached to licensed dispensaries. These are designated 21+ spaces where you can consume cannabis on-site.
- Public spaces: No. You cannot smoke or vape cannabis in parks, beaches, sidewalks, or any public area where smoking is prohibited under New Jersey’s Smoke-Free Air Act.
- Federal property: No. Cannabis remains federally illegal, so consumption on any federal land or in federal buildings is prohibited.
- In a vehicle: Absolutely not. Driving under the influence of cannabis carries the same serious penalties as alcohol-impaired driving. Keep your products sealed and stored during transport.
What Taxes Will You Pay?
Cannabis purchases in New Jersey are subject to two taxes:
- State sales tax: 6.625%
- Social equity excise fee: Currently 1/3 of 1%, paid at the point of sale. Note: Governor Murphy proposed increasing the cultivator-side social equity excise fee significantly in his 2026 budget, which could impact pricing down the line.
Local municipalities may also add up to an additional 2% transfer tax, so your total tax rate depends on where you shop. All in, expect to pay roughly 7–9% in taxes on recreational cannabis purchases in New Jersey.
Medical cannabis patients are completely exempt from state sales tax and the social equity excise fee. This has been in effect since July 1, 2022, making a medical card one of the best ways to save on cannabis purchases in New Jersey.
The 2026 Hemp Law: What Changed
One of the biggest legal shifts in 2026 is the new intoxicating hemp law signed by Governor Murphy in January. This law cracks down on the unregulated hemp-derived THC products (delta-8, delta-10, THCA) that have been sold in gas stations, smoke shops, and convenience stores across the state.
Here’s what the new law does:
- Immediately bans the sale of synthetically produced cannabinoids and any THC product sold to anyone under 21
- Starting April 13, 2026: Any hemp flower or product exceeding 0.3% total THC or 0.4mg total THC per container will be reclassified as “cannabis” and regulated by the CRC
- Starting November 13, 2026: Hemp-derived beverages exceeding 0.4mg THC per container will also fall under CRC regulation
- Online sales of intoxicating hemp products are now prohibited
What this means for consumers: if you want tested, regulated, legal THC products in New Jersey, licensed dispensaries are the way to go. The unregulated products that were available at smoke shops and gas stations are being phased out of the legal market.
Cannabis Consumption Lounges: A New Option
As of July 2025, New Jersey approved its first cannabis consumption area endorsements. These are 21+ spaces attached to licensed dispensaries where you can legally consume cannabis products on-site — think of them as a cannabis lounge, similar to a bar but without the alcohol.
A few things to know about NJ consumption lounges:
- Must be 21+ with valid photo ID
- No alcohol or tobacco products allowed inside
- No food or beverages sold on-site, but you can order delivery or bring your own food
- You cannot leave with open cannabis products — similar to open container laws for alcohol
- Only licensed Class 5 dispensaries with municipal approval can operate a consumption area
The first approved locations are in Atlantic City, Merchantville, and Newark, with more expected as municipalities continue to opt in.
Can You Grow Cannabis at Home in NJ?
Not yet. As of 2026, home cultivation remains illegal in New Jersey for both recreational and medical consumers. This has been a frequent topic of legislative discussion, and there’s a chance it could change in the future, but for now, all cannabis must be purchased from licensed dispensaries.
